These Terms of Service (“Terms”) govern your access to and use of the Konfirm, Inc. (“Konfirm”) platform, website, and related services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you are accepting on behalf of a company, you represent that you have authority to bind that company.

The Service

Konfirm helps ecommerce merchants confirm cash-on-delivery and other orders over WhatsApp by connecting their store, sending transactional confirmations from numbers they control, classifying replies, updating order tags, and routing uncertain cases to a human inbox — within configurable sending limits.

Accounts & eligibility

You must provide accurate registration information and keep it current. You are responsible for safeguarding your credentials and for all activity under your account. You must be at least the age of majority in your jurisdiction and operate a legitimate business.

Acceptable use

Your use of the Service is subject to our Acceptable Use Policy and our WhatsApp Use Policy. In particular, the Service is for transactional, customer-care messaging — not unsolicited bulk marketing. You are responsible for having a lawful basis to contact your customers and for honoring opt-outs.

Your content & data

You retain all rights to the data you connect or send through the Service (“Customer Data”). You grant us a limited license to process Customer Data solely to provide and secure the Service. Our handling of Customer Data is described in our Privacy Policy and Data Processing Addendum.

Third-party services

The Service integrates with third parties such as ecommerce platforms, WhatsApp, and payment processors. Your use of those services is governed by their own terms, and we are not responsible for them. WhatsApp is a trademark of its respective owner; Konfirm is not affiliated with, endorsed by, or sponsored by WhatsApp or Meta.

Fees & billing

Paid plans are billed in advance on a recurring basis through our payment processor. Fees are non-refundable except where required by law. We may change pricing with reasonable notice; changes apply to the next billing cycle. Late or failed payments may result in suspension.

Suspension & termination

You may cancel at any time from your account settings. We may suspend or terminate access if you breach these Terms, create risk or legal exposure, or fail to pay. On termination, your right to use the Service ends; we will make Customer Data available for a limited export window before deletion, subject to legal retention.

Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that message delivery is guaranteed by any underlying carrier or messaging provider.

Limitation of liability

To the maximum extent permitted by law, Konfirm will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability arising out of or relating to the Service will not exceed the amounts you paid to us in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold Konfirm harmless from claims arising out of your Customer Data, your use of the Service, or your breach of these Terms or applicable law, including messaging and consent laws.

Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the product or by email. Continued use after changes take effect constitutes acceptance.

Governing law

These Terms are governed by the laws of the jurisdiction in which Konfirm, Inc. is established, without regard to conflict-of-laws rules. Insert the governing jurisdiction and dispute-resolution venue here before publishing.
